2.05.05 Partnership / Limited Partnership / Limited Liability Partnership
Policy
A partnership, limited partnership (LP) or limited liability partnership (LLP) name must not be used when creating a client file.
General Information
Partnerships, limited partnerships or limited liability partnerships are not legal entities; therefore a registry agent must not create an organization client file using the name of the partnership.
A motor vehicle service for a client using a partnership name must only be completed under their individual or joint or organization client file.
Registration Address
When a client requests that their vehicle registration bear their partnership name, a registry agent must record "o/a the partnership name" in the first address line using the registration address applies procedure. Example:
John Smith o/a John Smith LLP 12305-45 Street NW Anywhere, AB T6L 6J5 |
Smith Construction Ltd. o/a Smith Bros Contracting 12305-45 St. NW Anywhere, AB T6L 6J5 |
Exception to Registration Address
The above registration address applies procedure does not apply when an organization that only runs as one partnership name requests their vehicle registration bear the partnership name. A registry agent must record “c/o the partnership name on the first address line of the postal address field on the demographic screen. Example:
c/o Smith’s Contracting
12305-45 St NW
Anywhere, AB
T6L 6J5
Exception
A client MVID may only be created for a partnership, limited partnership or limited liability partnership name for leasing purposes only. A registry agent must:
- Create a client MVID for the partnership, limited partnership or limited liability partnership name (as the lessor on a vehicle registration).
- Create an alert indicating:
- Client MVID created for leasing purposes only. No other motor vehicle services permitted.
