3.30.03 Administrative Suspensions
Policy
A definite or indefinite driver's licence suspension may be placed against a client’s driving privileges and/or vehicle registration under the Traffic Safety Act (TSA) for the following:
- Alberta Justice Administrative suspension.
- Medical suspension.
- Legal judgment suspension.
- Motor Vehicle Accident Claims (MVAC) suspension.
- Department/Ministerial Administrative suspension.
- Non-compliance of specific reinstatement conditions as a result of an impaired driving suspension.
- Alberta Transportation Safety Board (ATSB) suspension being administered by the Registrar of Motor Vehicle Services (Alberta Transportation).
- Suspensions arising from a Driver Conduct Review with the Registrar of Motor Vehicle Services (Alberta Transportation).
- Non-compliance with the National Safety Code (NSC) suspension.
Alberta Justice Administrative Suspension
An Administrative suspension may be placed against a client's driving privileges by Alberta Justice when the client:
- Has failed to comply with the maintenance enforcement obligations and have defaulted on their maintenance payments.
Reinstatement
A client's driver's licence will be reinstated:
- When a payment arrangement has been made with Alberta Justice. If the client defaults on the payment arrangement, the suspension may be re-activated.
Medical Suspension
A client’s driver’s licence may be placed under a medical suspension when:
- A physical or medical condition exists which adversely affects their ability to operate a motor vehicle.
- They have failed to comply with a request for medical information.
Reinstatement
A client driver’s licence will be reinstated on receipt of a satisfactory medical report.
Legal Judgment Suspension
A client’s driver’s licence or vehicle registration(s) may be suspended as a result of a legal judgment arising from a motor vehicle accident.
Reinstatement
A client’s driver’s licence will be reinstated:
- When payment has been made in full.
or - When a payment arrangement is in place.
- If the client defaults on the payment arrangement the suspension may be re-activated.
Motor Vehicle Accident Claims (MVAC) Suspension
A client’s driver’s licence and vehicle registration(s) may be suspended when:
- A debt has been paid by the MVAC fund on behalf of a client.
and - Arrangements to repay the debt have not been made.
Reinstatement
A client’s driver’s licence and vehicle registration(s) will be reinstated:
- When a payment arrangement has been made with the MVAC Fund.
- If the client defaults on the payment arrangement, the suspension may be re-activated.
Administrative Suspension
An Administrative Suspension may be placed against a client’s driving privileges when the client:
- Is suspended in another jurisdiction.
- Fails to comply with special conditions of licensing.
- Is non-compliant with specific reinstatement conditions as a result of an impaired driving suspension.
- Undergoes a Driver Conduct Review with the Registrar of Motor Vehicle Services (Alberta Transportation) including files being transferred from the Alberta Transportation Safety Board.
- Parent/guardian withdraws consent for a client under the age of 18.
Reinstatement
A client’s driver’s licence will be reinstated when the specified reinstatement condition code(s) has been met.
National Safety Code (NSC) Non-Compliance Suspension
Alberta Transportation, Carrier & Vehicle Safety may place a suspension against a client’s vehicle registration for non-compliance with the NSC requirements.
Reinstatement
A registry agent must contact Registries Assurance when a client presents a letter from Alberta Transportation, Carrier & Vehicle Safety indicating the NSC standards have been met.
Fines Payment Non-Compliance Suspension
Effective May 20, 2003, the Fines Payment Non-Compliance Suspension will no longer be issued as a result of a change in the TSA for:
- Unpaid fines totaling $500.00 or more.
or - Five or more unpaid fines.
A Fines Payment Non-Compliance Suspension issued prior to May 20, 2003 will remain in effect until the client pays all overdue fines in full.
